Raymond is a builder and is working on a new contract. Raymond visits Reddington Building Supplies Ltd on 1st December in order to buy some materials he needs for the job. He selects and pays for all the following goods except for the items in ii) below:
i)100 natural hessian venetian blinds. This represents the whole of Reddingtons stock of such goods.
ii)A pile of different coloured bricks which Raymond agrees to buy for 250 per half tonne. The contract price is to be determined when Raymond weighs out the bricks.
iii)A second hand JCB digger. The digger is immobile and needs 3 new tyres. Reddington agree to replace the tyres.
iv)50 larch fence panels. The panels are immediately moved to Reddingtons customer storage area and labelled with Raymonds address and delivery details. They are stored with identical larch panels which are marked up for each different customer.
Delivery is arranged for all the goods on 17th December. On 15th December Reddington Building Supplies Ltd become insolvent. In the factory the JCB digger has 3 new tyres on it.
Advise Raymond whether property has passed to him in any of the goods ordered and whether he can reclaim them from the liquidator of Reddington Building Supplies Ltd.You should use case law and statute law to support your answer.
